GENERAL TERMS AND CONDITIONS
FOR PARKING LOTS OF THE JOKER CENTER

(In Continuation: Parking Lot)

General Terms and Conditions for parking lots of the Joker Center – The parking rights are established along with the user obligations of the garage space – The parking lot is owned by JOKER d.o.o. Split, Put Brodarice 6, OIB: 49168006090, (from now on JOKER d.o.o.), which the parking lot users must respect.

1. Conditions of Acceptance

By entering the parking lot, you enter into a contractual relationship with JOKER d.o.o. in connection with the parking lot, thus accepting the terms and conditions of using the parking lot.

These terms apply to all users of the parking lot, including tenants, employees, and all persons in a business relationship with tenants who are not covered by the Lease Contract for using the parking lot.

2. RESPONSIBILITY OF JOKER d.o.o.

2.1. JOKER d.o.o., its employees, representatives, and contractors shall not be liable for any loss or damage to the vehicles and property located in the parking lot, which includes but is not limited to: scratches on the user’s vehicle in the parking lot, broken glass on the user’s vehicle in the parking lot, i.e., any damage to the user’s vehicle in the parking lot, stolen property from the user’s vehicle in the parking lot, etc.)

2.2. If a user of the parking lot witnesses damage to another vehicle and/or items stolen from a vehicle, the incident is to be reported to JOKER d.o.o. through its employees or the employees of the company designated by JOKER d.o.o. to manage the parking lot (Management Company), the parking lot security service and/or the police.

2.3. All users of the parking lot are obliged to report all criminal offenses, including damages, theft or attempted theft of a vehicle to the police and inform JOKER d.o.o. through the parking lot security.

2.4. Vehicle owners and drivers use the parking lot exclusively at their own risk. JOKER d.o.o. and/or the Management Company does not respond to damages and stolen property caused by third parties to parking lot users.

2.5. The parking lot is under video surveillance from 00 to 24 hours, but because the parking lot is publicly available by JOKER d.o.o. and/or the Management Company, it does not respond to the entry of third parties into the parking lot and also does not respond to any damage caused by their actions.

2.6. Video surveillance can be released only with the written order of the court or the police.

2.7. Recordings are stored for a limited time, according to the amount of time they can be kept.

3. SECURITY OF VEHICLES AND PROPERTY

3.1. Before leaving the vehicle at the parking lot, users are required to check if their windows are closed, the condition of the parking brake, and if the vehicle is locked.

3.2. When leaving the vehicle at the parking lot, users are obliged to take their belongings with them and ensure that the items remaining in the vehicle are stored in a safe and hidden place. Users of the parking lot leave items in their vehicles at their own risk.

4. PRICING AND FEES FOR PARKING LOT USERS

4.1. The parking lot operates from 00:00 to 24:00

4.2. From 7:00 to 24:00, parking is free of charge for the first three (3) hours, and Cinestar cinema visitors can spend an additional one hour in the parking lot at no charge. The extra free hour for cinema users is redeemed by presenting the parking card to the cinema staff.

4.3. Upon the expiration of 3 (three) hours, and for 4 (four) hours for Cinema guests at the parking lot, each additional hour is charged at 2,00 eur from 7:00 to 24:00. From 00:00 to 07:00, the parking fee is 2,00 eur for each hour of a parking lot use.

4.4. The parking fee must be paid before entering the vehicle, with cash at the payment system on the  -1 floor, next to the Bio Planet store.

4.5. After you have paid and received your parking ticket, you have 15 minutes to leave the parking lot.

4.6. In the event you lose your parking ticket, you must pay a fee of 30 eur (thirty euros). Payments are made at the payment system on the -1 floor near the Bio Planet store.

4.7. JOKER d.o.o. or the Management Company reserves the right to change the fee for the use of the parking lot without prior notice and without the consent of the user of the parking lot. Parking fees are highlighted at the parking reception. Users can remain inside the parking lot for a maximum of 48 hours, except in the case of prior written consent from JOKER d.o.o. or the Management Company.

5. UNPAID COSTS

5.1. Until the parking lot user pays the parking fee, the vehicle will not be released from the parking lot, i.e., the exit ramp will not be lifted. The vehicle will be discharged from the parking lot only upon paying the parking fee. In the event of malicious behavior by blocking the exit ramps, disrupting the work of the parking lot, or hindering the parking lot staff, JOKER d.o.o. or the Management Company has the right to remove the vehicle at the expense of the vehicle owner and charge a fee in the amount of 30,00 eur for violating the obligation of using the parking lot.

5.2. If the vehicle owner does not cover the costs incurred, JOKER d.o.o. or the Management Company reserves the right to initiate the appropriate procedure for charging unpaid and other related costs.

6. SECURITY INSIDE THE PARKING LOT

6.1. Users of the parking lot are obliged to drive carefully inside the parking lot and respect signaling directions, and the right of way, and adjust speed to the specified limit.

6.2. The height limit of the vehicle is located above the entrance to the parking lot and inside the parking lot.

6.3. Users of the parking lot are obliged to park the vehicle within the markings for a single parking space. Parking in more than one parking space is not permitted and will be considered an illegal parking job subject to the measures referred to in Articles 9. and 12. of these Terms.

7. RISK OF DAMAGE TO VEHICLES OR ASSETS IN THE PARKING LOT

7.1. In the event of damage to another vehicle or any part of the property or the parking lot facility itself, the parking lot user shall immediately report it to the authorized JOKER d.o.o., the Management Company of the parking lot, or the police.

7.2. In the event of damage to another vehicle, employees of JOKER d.o.o. or the Management Company may request registration data for the vehicle and any other vehicle involved in the incident.

7.3. In the event of damage to any part of the property or structure of the parking lot, JOKER d.o.o. or the Management Company of the parking lot are authorized persons to claim damages and cover the costs JOKER d.o.o. or the Management Company had to pay to repair the damages.

8. PROHIBITED WORK INSIDE THE PARKING LOT

8.1. Inside the parking lot, it is forbidden to:

• perform any activities related to the sale, rental, and provision of services, and disposal of vehicles or movable property,
• park the vehicle in such a way that it also impedes the other users of the parking lot – blocking the entrance or exit or posing an obstacle inside the parking lot,
• hinder other users of the parking lot – inappropriate behavior,
• park the vehicle in a space for a special type of vehicle or a special category of the driver (persons with disabilities, mothers with children, etc.) if the owner of the vehicle or driver does not belong to the said category,
• park an unauthorized vehicle for more than 48 hours,
• clean vehicles within the parking lot,
• dispose of waste or garbage within the parking lot,
• place promotional material (leaflets, posters, flyers, business cards) without the explicit permission of JOKER d.o.o. or the Management Company,
• smoke inside of the parking lot,
• tow vehicles inside of the parking lot,
• service vehicles inside of the parking lot

8.2. All activities contrary to applicable legal regulations are forbidden at the parking lot.

9. ACCESS AND REMOVAL OF VEHICLES

9.1. In the event of improper parking at the parking lot, according to Article 6.3. of these Terms, JOKER d.o.o. or the Management Company will call a towing service and remove the improperly parked vehicle.

9.2. JOKER d.o.o. or the Management Company has the discretion to refuse entry of any vehicle to the parking lot for any reason, without giving reasons.

9.3. If one part or the whole parking lot must be closed (temporary or permanent) or if the parking lot has to be evacuated, either in the event of an emergency or for other reasons, JOKER d.o.o. or the Management Company has the right to restrict access to the parking lot and/or move the parked vehicles outside the parking lot.

9.4. JOKER d.o.o. or the Management Company has the right to move vehicles if they are parked contrary to these Terms, including, but not limited to, the following:

• blocking the exit in case of danger,
• causing a potential fire hazard,
• hindering other users of the parking lot,
• obstructing the maintenance of the parking lot,
• parking outside of a designated space or parking in two or more designated parking spaces,
• posing a security risk to the parking lot and other users of the parking lot,
• posing a threat to health and safety

10. ABANDONED VEHICLES

If a vehicle remains unauthorized at the parking lot for more than 48 hours, JOKER d.o.o, the Management Company, or the Contractor have the right to remove the vehicle by means of a towing service at the expense of the vehicle owner.

11. PROHIBITED ENTRY TO THE PARKING LOT

JOKER d.o.o. or the Management Company have the right to prohibit access to the parking lot for vehicles that have not complied with these Terms by their assessment. Vehicles with natural gas are forbidden to enter the parking lot, which is highlighted above the entrance to the parking lot.

13. COMPLAINTS

If you need further clarification of these Terms and Conditions and have any complaints, you may contact JOKER d.o.o. or the Management Company and can address your complaint in writing to JOKER d.o.o. using the email address: info@joker.hr

14. OTHER

14.1. JOKER d.o.o. or the Management Company reserves the right to change these Terms at any time and is obliged to do so in writing.

14.2. These Terms shall be applied and interpreted by the laws of the Republic of Croatia.
